By purchasing any Sonic Barrier product, you acknowledge and agree that you have read and understood the safety warnings applicable to your product as described on our Disclaimer page and in the product manual.

You agree to use the product only in accordance with the instructions provided and within the product's stated specifications.

You agree not to open, modify, disassemble, or alter the product or its components, including batteries and electrical connections.

You acknowledge that misuse, modification, or use outside the product's specifications voids all warranties and releases The Pest Repeller or Sonic Barrier from liability for any resulting damage or injury.

For battery-powered products, you acknowledge that lithium-ion batteries require proper handling and that failure to follow safety instructions may result in fire, explosion, or chemical leakage.

For plug-in products, you acknowledge that electrical products must be connected to the correct voltage and that improper use may result in electrical shock, fire, or property damage.

10. Limitation of Liability

To the fullest extent permitted by law, The Pest Repeller and Sonic Barrier, along with their officers, employees, affiliates, agents, and suppliers, shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or any products purchased through it.

In jurisdictions that do not allow such limitations, our liability shall be limited to the maximum extent permitted by law.

With respect to claims arising from product defects, our maximum aggregate liability shall be limited to the purchase price paid for the product giving rise to the claim, except where applicable law prohibits such limitation.

This limitation applies regardless of the legal theory upon which the claim is based, including contract, tort, strict liability, or otherwise.

Products sold under The Pest Repeller or Sonic Barrier brands are sourced from third-party manufacturers.

We do not design or manufacture our products.

To the extent permitted by law, claims arising from design or manufacturing defects may be directed to the original manufacturer.

11. Indemnification

You agree to indemnify and hold harmless The Pest Repeller and Sonic Barrier, their parent company, affiliates, officers, directors, employees, agents, and suppliers from any claims, demands, or damages, including reasonable attorneys' fees, arising from your breach of these Terms or your violation of any law or the rights of any third party.

12. Arbitration and Class Action Waiver

By using or purchasing products or services from The Pest Repeller or Sonic Barrier, you agree that any controversy, claim, or dispute between you and the company arising out of or relating to these Terms, your use of the Site, or any alleged violation of law shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

The arbitrator shall issue a written decision including findings of fact and law. Each party shall bear its own attorneys' fees and other costs.

Claims shall be heard by a single arbitrator.

Arbitrations shall take place in Bernalillo, New Mexico, United States, although the parties may choose to appear in person, by phone, or through submission of documents.

Arbitration shall be governed by the Federal Arbitration Act and the internal laws of the State of New Mexico.

You may opt out of arbitration within thirty days of your first purchase by sending written notice to RankForge LLC, 1209 Mountain Road PL NE STE N, Albuquerque, NM 87110, United States.

Your notice must include your name, address, and a clear statement that you do not wish to resolve disputes through arbitration.

You and The Pest Repeller or Sonic Barrier agree that claims may only be brought in your individual capacity and not as part of any class action, consolidated action, or representative proceeding.

13. Severability

If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be enforced to the fullest extent permitted by law and the remaining provisions shall remain in full force and effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States.

Notwithstanding the foregoing, product liability claims arising from manufacturing defects may be subject to applicable international product liability laws and conventions, including claims that may be directed to the original manufacturer in their jurisdiction.

We reserve the right to update these Terms at any time.

Changes will be posted on this page with an updated date.
